How does prescription fraud work?

Any substances from pain relievers to Benzodiazepines to stimulants which are fraudulently obtained can result in your arrest.

An arrest can come as a result of any of the following:

  • Using false information or falsified documents to obtain controlled substances
  • Issuing a prescription with a forged or fictitious signature
  • Using another person’s prescription to prescribe a Schedule II drug
  • Delivering a prescription or its form for any non-medical reason
  • Possessing a controlled substance by misrepresentation, fraud, forgery, or deception
  • Using a fake or suspended registration number during the making, distributing, or prescribing of substances

Penalties depend on the type of substance you are accused of obtaining through fraud. If convicted of prescription fraud for a Schedule I or II drug, you could face between 20 and 20 years in prison and/or up to $10,000 in fines. A fraud conviction for a Schedule III or IV drug can lead to between 2 and 10 years in prison and/or up to $10,000 in fines.
