In a recent case our firm handled, a female client came to us facing misdemeanor
theft charges. According to the
Texas Penal Code §30.03 (2011), theft occurs when a person "unlawfully appropriates property
with intent to deprive the owner of property." Simply stated, theft
is taking something without the owner's permission and without any
intention of returning the item.
The charges of theft will differ depending on the amount that was stolen.
A Class C misdemeanor charge can be brought against someone who stole
something valued at less than $50. If they stole property valued between
$50 and $500, they will be charged with a Class B misdemeanor. Lastly,
if they stole between $500 and $1,500, they could be facing charges of
a Class A misdemeanor.
Our client could have been facing harsh penalties, but we were able to
get her misdemeanor charges dropped and her case dismissed. If you were
