Intoxication As A Defense - Or Not?

Posted By Dellah Streech || 11-Aug-2010

Recently Dallas criminal defense attorney, Tom D'Amore, was questioned on the legality of an arrest and confinement regarding the crime of assault on a public servant.  The question was whether the individual had the requisite intent to "assault" the police officer as the individual was intoxicated.

Voluntary intoxication is not a defense under Texas law.  If the individual had become intoxicated voluntarily, then he did not have a viable defense.  There are many different defenses under Texas law.  The D'Amore law firm can help you understand what might be applicable in your case.
