After an Iraq war veteran was convicted for shooting his ex-girlfriend,
prosecutors attempted to get him sentenced to at least 30 years in prison. Our

charged as a 1st degree felony with a range of punishment of up to life in prison with

The defendant—a 34-year-old man who had served in the Iraq war in
the U.S. Marine Corps—claimed self-defense in his case. The man's
ex-girlfriend said that he shot her one time in the forehead, one time
in the neck and one time in the shoulder. According to the Marine's
statement to police, however, she was the one who had pulled the gun on
him, which caused the man to act in self-defense. He stated that the incident
occurred after he had gone to her place of work to pay her for child support
and the two of them got into an argument. According to evidence presented
in the case, the Marine had received a diagnosis of PTSD (Post-Traumatic
Stress Disorder) once he came back home from serving in the war.
A jury ended up convicting the defendant. Attorney D'Amore, however,
continued fighting for a case result that could benefit his client. He
asked the jury to consider sentencing the Marine to probation rather than
the 30 years or more of prison time that prosecutors were asking for.
In the end, the jury ended up sentencing the man to a 10-year probation
term. This is a sentence that is dramatically lower than what the defendant
